Security Trade Control (Parameter Sheet / EAR Compliance Determination)

Precautions
- The objectives of our PARAMETER SHEET assessed along with Appended Table 1 of the Export Order enacted on February 1, 2024 ("Export Order") and respective control lists based on the U.S. Export Administration Regulations as of December 1, 2023 ("EAR") are to show our view on applicability of KGS products marketed as of such dates and to help customers use as referential information for their own applicability determination.
- The Parameter Sheet and EAR Compliance Determination are only intended to provide an assessment along with the Export Order and the EAR, respectively, so that KGS makes no warranties concerning the legality of exporting the products. When exporting KGS products, the necessary procedures are to be taken by customers in accordance with the Foreign Exchange and Foreign Trade Law, EAR, and other related laws and regulations.
- The Parameter Sheet and EAR Compliance Determination only cover Appended Table 1 of the Export Order and the EAR, respectively, so that any other laws and regulations are out of scope of our assessment. As for any export transactions conducted by customers, they are required to examine the permissibility of the transactions and take the necessary procedures by themselves in accordance with related laws and regulations in Japan as well as export destinations.
- The Parameter Sheet and EAR Compliance Determination are provided based on the Export Order and the EAR as of such dates indicated in 1. above, so that they become invalid after such dates if any revisions are made to the laws.
- The Parameter Sheet and EAR Compliance Determination only cover KGS-made products based on its own individual specifications indicated therein. They are not applied if such KGS-made products have been incorporated, processed, disassembled, and altered.
- Terminology of the PARAMETER SHEET

Parameter Sheet assessed along with Appended Table 1 of the Export Order
"Category 1-15 / Assessment" indicates if a product series or part number falls under any of Category 1 through 15 of Appended Table 1 of the Export Order, while "Not subject" indicates that a product series or part number does not fall under any of Category 1 through 15 of the Appended Table 1. Even if a product series or part number is determined to be inapplicable or not subject to any of Category 1 through 15 of Appended Table 1, it is still covered by Category 16 for catch-all controls.
A product series or part number applicable to Category 16 will be subject to the Foreign Exchange and Foreign Trade Law in accordance with the final destination, purpose of use, and end-users. Customers as the exporter are required to confirm and determine the applicability of the transaction by themselves, and if necessary, obtain permission from the Minister of Economy, Trade and Industry of Japan. -
Determination of EAR Compliance
"Determination" implies our view on product applicability under the EAR, while "Not Subject" implies that the product is unregulated by the EAR pursuant to EAR§734.4 and Supplement No.2 to Part 734.
As for particular items subject to the EAR and list control, the U.S. Export Control Classification Numbers (ECCN) are shown in the corresponding "Determination" column.
EAR99 items refer to items which are not listed on the Commerce Control List (CCL), while any EAR99 items actually fall under U.S. Department of Commerce jurisdiction. EAR99 items may be regulated in accordance with the final destination, purpose of use, and end-users. Customers are required to confirm and determine the applicability by themselves, and if necessary, obtain a license from the U.S. government.
This Determination is only applied if the products are not going to an terrorist-supporting, embargoed, or sanctioned country/region pursuant to the provision of the EAR. - The Parameter Sheet and EAR Compliance Determination are subject to change without prior notice, and KGS makes no warranties accompanied by such changes. They are provided for informational purposes only, and KGS will not bear any responsibility for any direct or indirect damages arising from use of the provided information in any case. The provided information should be used at your own discretion and risk in accordance with relevant laws.

As for export transactions or provision of the Products, the Company will never allow an exporter and end-user to develop, manufacture,
